divided federal appellate panel affirmed a capital judgment for an Arizona man.


Two judges on the 9th U.S. Circuit Court of Appeals panel, Barry G. Silverman and
Kim McLane Wardlaw, voted to reject Lezmond C. Mitchell's habeas appeal.
