Blanket Access to Trial Documents Hurts System

On Oct. 27, the Judicial Council of California, following the California Supreme Court's decision in NBC Subsidiary (KNBC-TV) Inc. v. Superior Court, 20 Cal.4th 1178 (1999), adopted new rules that establish that "trial court records are presumed to be open" and cannot be sealed absent an "overriding interest that overcomes the right of public access." California Rule of Court 243.1 (effective Jan. 1).
