Judge's jury-picking mistakes do not require new trial, state high court rules

The state Supreme Court on Thursday rejected a criminal defendant's plea for a new trial because the judge overseeing his case erroneously refused to strike two biased individuals from the jury pool.

The state Supreme Court on Thursday rejected a criminal defendant's plea for a new trial because the judge overseeing his case erroneously refused to strike two biased individuals from the jury pool.


The court said as long as defendants can correct such a mistake using peremptory challenges - removal of jurors without a stated reason - they have received a fair trial.
