State high court to take up 'suitable seating' question

Asked for their opinion by the 9th Circuit, state Supreme Court justices will look into whether employers are obligated to provide seats to clerks and cashiers.

The state Supreme Court has agreed to weigh in on whether employers are obligated to provide seats to clerks and cashiers.


The question comes by way of the 9th U.S. Circuit Court of Appeals, which asked the state high court for its opinion.
The 9th Circuit drafted several questions for the state Supreme Court to answer, but the court could reframe the questions or limit the issues it hears.
