State Supreme Court: Sex Predators Can't Claim Incompetency

Alleged sexually violent predators don't have the right to claim they are mentally incompetent to undergo a civil commitment hearing, the California Supreme Court ruled Thursday.

Alleged sexually violent predators don't have the right to claim they are mentally incompetent to undergo a civil commitment hearing, the California Supreme Court ruled Thursday.

Justice Marvin R. Baxter, writing for the 5-2 majority, said the need to protect the public outweighs a defendant's constitutional right to due process. Moore v. Superior Court, 2010 DJDAR 13041....
