Judge Lifts Stay on Prop. 8 Ruling Effective Aug. 18
Northern District Chief Judge Vaughn R. Walker ruled Thursday that gay couples should be allowed to marry while the proponents of Proposition 8 appeal his ruling striking down the same-sex marriage ban as unconstitutional. But the judge left his temporary stay in place until August 18 at 5 p.m. to allow the proponents to appeal that decision to the 9th U.S. Circuit Court of Appeals. In his order, Walker found that the evidence and the positions of Gov. Arnold Schwarzenegger and Attorney General Jerry Brown against a stay "show that an injunction against enforcement of Proposition 8 is in the public's interest."
