Earlier this year, Gov. Jerry Brown signed Senate Bill 496. The bill revises Civil Code Section 2782.8 and modifies design professionals' contractual duty to defend by limiting their potential liability for defense fees and costs to their proportionate percentage of fault as found by a trier of fact.
