The U.S. Supreme Court will consider arguments today about whether trademark owners can withdraw those marks after they already filed a complaint to avoid a possible invalidity finding.
Long a sticking point for lower courts, it has now caused a split between the 2nd and 9th U.S. Circuit Courts of Appeals.
