Death Penalty Testimony Barred

The first attempt to use Proposition 9 in court to express a victim's views on the death penalty fell through this week, but it could serve as a road map.

MARTINEZ - Although the first attempt to use Proposition 9 in court to express a victim's views on the death penalty fell through this week, attorneys could be encouraged to use the 2008 state legislation in future, similar litigation, a Berkeley attorney said Wednesday.
