False Claim Upends CEO's Conviction
In a setback for the government's crackdown on white-collar crime, a federal appellate panel Tuesday reversed former Brocade Communications Systems Inc. CEO Gregory L. Reyes' conviction for stock options backdating.

Daily Journal Staff Writer SAN FRANCISCO In a setback for the government's crackdown on white-collar crime, a federal appellate panel Tuesday reversed former Brocade Communications Systems Inc. chief executive Gregory L. Reyes' conviction for stock options backdating. Prosecutorial misconduct fatally flawed the government's closing argument to jurors, a unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals ruled.
