Panel Says Judges Must Decide Arbitration Clauses' Fairness
SAN FRANCISCO - In a sharply divided ruling, an 11-judge panel of the 9th U.S. Circuit Court of Appeals ruled Monday that challenges to arbitration clauses must be decided by a judge, not the arbitrator. Nagrampa v. MailCoups Inc., 03-15955 (9th Cir. Dec. 4, 2006).
