In Tricky Dance of Appeals, Timing of Filing Is Everything

Focus Column - By Margaret M. Grignon - In addition to death and taxes, it is also a certainty that the California Court of Appeal will order dismissal of an untimely appeal from an appealable order. This is not because the Court of Appeal is such a stickler for detail, but because the timeliness of the filing of a notice of appeal is jurisdictional and must be raised by the Court of Appeal on its own if it is not raised by the opposing party.
