'Viner' II Offers Guidance to Manage Problems of Proof
Focus Column - Legal Malpractice - By Alec H. Boyd - In Viner v. Sweet, 30 Cal.4th 1232 (2003) ("Viner I"), the state Supreme Court held that in legal malpractice actions arising from an attorney's representation of a client in a transaction, as opposed to litigation, the client must show that "but for" the attorney's malpractice the client would have obtained a better result.
