Forum Column - By Michael Rushford - The U.S. Supreme Court announced in Atkins v. Virginia that executing the mentally retarded constitutes cruel and unusual punishment. While the constitutional basis for such a decision can be debated, the need for it cannot. Atkins is an affront to the jury system and a intellectually dishonest attempt to correct a problem that doesn't exist.
