Affirmative Assent

The law's patience with the fiction of posted online agreements may be nearing an end. The U.S. District Court in New York, applying California law, has rendered a decision that threatens to undermine basic assumptions that most online businesses have made about how their activities will be governed. Specht v. Netscape Communications Inc., 150 F. Supp.2d 585 (S.D.N.Y. 2001).
