How far does potential nondisclosure liability extend for providers of "commercial information"? California's 2nd District Court of Appeal recently answered this question when it held that a property inspection company could be liable to a real estate broker for equitable indemnity if it failed to make adequate disclosure in a property inspection report, even where the inspection company supplied its report for an unrelated transaction involving an unrelated third party.
