Carhart, the Supreme Court voted 5-4 to strike down a Nebraska statute making performance of a "partial-birth abortion" a crime carrying a penalty of up to 20 years in prison. Ultimately, the disagreement between the majority and the dissent turns not upon a woman's right to choose how to terminate her pregnancy, but whether she should possess such a right at all.
