The 9th U.S. Circuit Court of Appeals ruled Wednesday that federal courts cannot have a blanket policy for shackling all defendants appearing in pretrial hearings. The en banc panel also ruled that judges cannot delegate the decision on whether or not to shackle a defendant to the U.S. Marshals Service or other law enforcement agencies.
