In a recent win, Rubin settled a class action on the eve of trial, brought against Rite Aid by 23,000 cashiers seeking to enforce a century-old law that requires the retailer to provide them seating. In the agreement, the employer agreed to pay $18 million and start a pilot program where cashiers will have chairs or stools available to them. Hall v. Rite Aid Corporation, 37-2009-00087938-CU-OE-CTL (San Diego Super. Ct., filed April 17, 2009).
