Facebook tries to persuade 9th Circuit to dismss invasion of privacy suit

A Facebook Inc. attorney told a 9th U.S. Circuit Court of Appeals panel Wednesday that the collection of facial recognition data is not an invasion of privacy unless the information is “disclosed” or “misused.”

The three-judge panel considered the issue at a hearing over whether a proposed class of millions of Illinois plaintiffs alleging Facebook improperly gathered and stored their biometric data should be overturned.
