Challenged cy pres award heads back to district court

After a trip to the U.S. Supreme Court, challenges to a settlement in which millions of class members received nothing but the attorneys’ alma maters got the benefit are headed back to a San Jose federal court.

The 9th U.S. Circuit Court of Appeals’ mandate to remand and re-hear challenges to a controversial settlement in which millions of class members received nothing went into effect Tuesday, clearing the way for an important discussion about cy pres settlements to unfold in a San Jose federal trial court.
