Uber, Postmates claim gig worker law is unconstitutional
Uber’s and Postmates’ opposition filing said there is no rational basis for how AB 5 requires some California workers to pass a three-pronged “ABC” test to qualify as independent contractors but holds other workers to different standards.





Assembly Bill 5 violates' the rights of workers to choose their occupation, unconstitutionally upsets gig economy contracts, and arbitrarily makes it harder for some workers to qualify as independent contractors while making it easier for others, according to court filings by Uber Technologies Inc. and Postmates Inc.
