Pinterest defeats photographer’s infringement claim

U.S. District Judge Haywood S. Gilliam Jr. in Oakland declined to find that Pinterest’s algorithm, which invites its users to distribute the content available on its platform as a form of advertising, violated the act because “plaintiff offers no case law to support his theory that the use of computer algorithms to analyze user engagement and to tailor advertising prevents the application of” the Digital Millennium Copyright Act’s safe harbor provision.

Pinterest defeated a copyright infringement claim by a photographer when a federal judge granted its motion for summary judgment while striking down the plaintiff’s competing motion because he suspected the plaintiff was “attempting an end-run around” the Digital Millennium Copyright Act.
