School not liable for student bullying, defense attorney says

“As there was no way for defendant to anticipate the random act of violence, they had no duty to prevent the same,” stated Joshua Bordin-Wosk, a Los Angeles partner at Bordin Semmer LLP.

Attorneys defending the Claremont School District in a lawsuit saying it allowed bullies to repeatedly beat and verbally abuse a seventh grade student, filed an answer Thursday arguing the school has no duty or way to control random behavior of others.

The reply also says that if the boy was injured it is due to his own negligence or fault, and that the claims of abuse are exaggerated.
