EPA can't ignore risk of fluoride brain damage, judge says

While he did not conclude that fluoridated water undoubtedly caused harm, U.S. District Judge Edward M. Chen wrote in his order that the mineral was present in drinking water at levels that posed an "unreasonable risk of injury" to public health under the Toxic Substances Control Act.

After presiding over the first trial challenging the dismissal of a citizens' petition under the Toxic Substances Control Act, a federal judge in San Francisco dealt a blow to the U.S. Environmental Protection Agency's regulation of fluoride levels in drinking water.
