Judge upholds demurrer in luxury hotel v. affordable housing case

Los Angeles successfully demurred against claims that it unlawfully approved a luxury hotel project, leading to the demolition of affordable housing. Judge Chalfant ruled the complaint was not timely served on necessary parties.

The City of Los Angeles successfully demurred on Tuesday to claims that it unlawfully pushed through a luxury hotel development in Hollywood that would require the demolition of affordable housing units.

The city and related defendants had filed demurrers to two causes of action on the grounds that petitioner United Neighborhoods for Los Angeles had failed to timely file the complaint against the Whitly Apartments, the hotel's developer. Los Angeles County Judge James C. Chalf...
