Judge: Pen register restrictions not isolated to telephonic surveillance

U.S. District Judge R. Gary Klausner declined Autotrader attorneys' argument that that a claim related to a restriction of the use of pen registers without consent under California Penal Code, Section 638.51 was restricted to telephone communications.

A putative class action that uses California's wiretapping law to challenge alleged unlawful online tracking software was kept alive by a federal judge in Los Angeles after he found sections of the invasion of privacy statute were not limited to just telephonic surveillance.
