US insists it didn't maliciously prosecute Erika Girardi's fashion designer

In an $18M lawsuit, the U.S. government seeks dismissal, denying malicious prosecution claims against Erika Girardi's ex-fashion designer.

In an $18 million conspiracy lawsuit that targets Erika Girardi -- and cleared Secret Service agents of any wrongdoing -- attorneys for the government on Tuesday reaffirmed its position that it did not maliciously prosecute the plaintiff for credit card fraud.

The government, which was added to the case in an amended complaint, argued the plaintiff's claims were mischaracterized and grounds for a dismissal.
