Court upholds arbitration award against Gibson Dunn in partner pay dispute
Mark A. Perry left the firm to join Weil, Gotshal & Manges. Gibson Dunn denied retirement payments, asserting he was competing with and harming the partnership. Perry argued he was a retired partner entitled to payments once he stopped competing.
A California Court of Appeal affirmed an arbitration award requiring Gibson, Dunn & Crutcher LLP to pay retirement benefits to a former partner who left for a competitor, holding the firm's arbitration agreement did not permit courts to review the arbitrator's legal conclusions and highlighting the high bar for vacating awards on legal error grounds.
