With increasingly overburdened courts, Hilberman said parties are searching for alternatives to settle their disputes.
"The court funding issue is very critical," he said. "The reduction in trial court availability is resulting in delays in trials and the access to justice. That results in a greater willingness to see resolutions, including mediation and arbitrations."
