9th Circuit: Evidence obtained using torture cannot be basis for extradition

Testimony obtained through torturing witnesses cannot be used as valid evidence in extradition proceedings, a divided en banc panel of the 9th U.S. Circuit Court of Appeals ruled Thursday.
The panel decided in favor of Jose Luis Munoz Santos, a Mexican man in the U.S. who faces extradition so he can be charged in Mexico for kidnapping and holding for ransom a woman and her two daughters.
