A recent article in the Daily Journal discusses the 9th U.S. Circuit Court of Appeals decision in Pacheco v. United States, 220 F.3d 1126 (9th Cir. 2000), in which 11-year-old Ivy Pacheco, while wading in the shallow water of a government-operated beach, was suddenly swept out to sea by a riptide and drowned, as were her mother and grandmother, who attempted to rescue her.
