Government approval of a new subdivision is often conditioned upon the developer agreeing to construct offsite improvements, like streets, storm drains and sewers. Gov. Code Section 66411.1. The agreement usually requires the developer to post security to assure that the work is done and that contractors and suppliers are paid. The payment security is often a payment bond.
