Defendant ScoreInc.com is facing an uphill battle to win legal fees from plaintiff DisputeSuite.com LLC following oral argument Tuesday before the state Supreme Court.

The high court convened in Sacramento to consider whether and to what extent state judges have discretion to shift fees when a contractual dispute is dismissed on procedural grounds.
