SEC, immigration lawyer file dueling summary judgment motions

Attorneys agreed that whether the EB-5 visa investments count as securities will depend on whether applicants expect and receive a profit.

The Securities and Exchange Commission and a lawyer accused of fraud in connection with the EB-5 Immigrant Investor program have filed dueling summary judgment motions in a test enforcement case that, if successful, would subject attorneys to registration requirements normally reserved for brokers negotiating investments for clients.
