Court Won't Discipline Bybee

The 9th U.S. Circuit Court of Appeals says Jay S. Bybee's role in the Bush administration's "torture memos" occurred before he was a judge.

SAN FRANCISCO - The 9th U.S. Circuit Court of Appeals cannot discipline Circuit Judge Jay S. Bybee for his role in the Bush administration's so-called "torture memos" because Bybee was not a judge at the time the memos were drafted, the circuit has ruled.
