The city of San Diego has challenged the State Water Resources Control Board over a fee it claims is really an illegal tax under Proposition 26.
The fee itself — $216,000 — is a modest amount in the world of water disputes. However, a successful challenge could undercut the water board's ability to charge this fee in the future.
