Chiantelli said he has noticed a rise in parties choosing mediation as a first resort before filing a lawsuit.
"It's a way to resolve their differences without undergoing the expenses of litigation," said Chiantelli, a retired San Francisco County Superior Court judge now working as a mediator for ADR Services Inc.
In another sign of the times, he said he is seeing more promissory notes being offered in settlements.
