Appeals Court OKs Defendants' Right to Class-Action Residues

Focus Column - By Steven B. Katz - On Jan. 9, the 1st District Court of Appeal held in In re: Microsoft I-V Cases , 2006 DJDAR 331, that trial courts have the discretion to approve class action settlements in which some (or all) of the unclaimed settlement funds revert to the defendant. Although most trial courts throughout the state proceeded on the assumption that such settlements were permissible, In re: Microsoft I-V Cases lays to rest all dispute over the subject.
