Court Restricts Drug-Test Use In Pregnancy

LOS ANGELES - State hospitals cannot drug-test pregnant women without consent and give the results to the police, the U.S. Supreme Court said Wednesday. In a 6-3 decision, the high court rejected the Medical University of South Carolina's claim that the "special needs" of newborn babies vitiate the Fourth Amendment's protection against unlawful search and seizure. Ferguson v. City of Charleston, 2001 DJDAR 2839 (U.S. March 21, 2001).
