9th Circuit clarifies law governing pain and suffering damages

In a family's wrongful death and excessive force suit against the Los Angeles police over an officer's 2008 shooting of an autistic Muslim man, a federal judge should not have dismissed claims and stricken a jury's $1 million damage award, an appeals panel held on Monday.
The 9th U.S. Circuit Court of Appeals sent the case back to U.S. District Judge R. Gary Klausner for further litigation....
