Prosecutors cannot rescind a plea deal when a defendant who pled guilty to a felony seeks a lesser sentence under Proposition 47, the state Supreme Court held Thursday.
The 2nd District Court of Appeal had held that prosecutors could withdraw from a plea bargain and reinstate criminal charges against defendant Morris Glen Harris Jr., who was eligible for Prop. 47 relief.
