Johnson & Johnson subsidiary will pay $85 million fine in criminal case

A Johnson & Johnson subsidiary pleaded guilty Wednesday to a misdemeanor violation of the Food, Drug and Cosmetic Act.

Scios Inc., a Fremont-based subsidiary of Johnson & Johnson, pleaded guilty on Wednesday and agreed to pay an $85 million criminal fine for a misdemeanor violation of the Food, Drug and Cosmetic Act. Scios promoted its heart failure drug for a use that was not approved by the U.S. Food and Drug Administration, a crime known as off-label marketing.
