A Carefully Crafted Arbitration Clause Can Preclude Litigation

Focus Column - Alternative Dispute Resolution - By Paul W. Taylor - The 4th District Court of Appeal recently filed its opinion in Harper v. Ultimo, 2003 DJDAR 13225 (Cal. App. 2nd Dist. Dec. 5, 2003), holding that an arbitration clause utilizing Better Business Bureau arbitration rules was not enforceable on the grounds of both procedural and substantive unconscionability.
