9th Circuit Inches Toward Mandatory-Arbitration Support

Forum Column - By Rex Darrell Berry - Over the last decade, more and more employers have embraced mandatory pre-dispute arbitration agreements as a condition of employment. The attractiveness to employers of these agreements is not hard to fathom. Employers are legitimately wary of having management decisions, made in the heat of battle, second-guessed years later by a jury with little or no management experience.
