New 'Bounty-Hunting' Law Threatens State's Employers

Forum Column - By Joseph E. Herman - On Jan. 1, 2004, the Private Attorneys General Act of 2004 went into effect, opening the hunting season on California employers. Enacted as SB796 and codified as Labor Code Section 2698, this law authorizes employees to bring private actions to enforce existing penalties for all Labor Code violations (except workers' compensation claims) and creates new penalties for violations when the code does not establish a specific penalty.
