Panel affirms decision, vacates award in "Vogue" case

The use of a trumpet riff in Madonna's 1990 song "Vogue" was affirmed as de minimis by a 9th U.S. Circuit Court of Appeals panel Thursday.

The use of a trumpet riff in Madonna's 1990 song "Vogue" was affirmed as de minimis by a 9th U.S. Circuit Court of Appeals panel Thursday.

But the panel's decision to vacate and remand a $670,000 attorney fees award was a victory in the eyes of plaintiff's counsel Robert S. Besser.
