High Court Takes Sentencing Case
The U.S. Supreme Court agreed Monday to consider whether a federal district judge has the authority to order a sentence to run consecutive to an anticipated, but as-yet-unimposed state sentence.
The appellate courts are split 4-4 on the issue. The 9th U.S. Circuit Court of Appeals is one of the circuits that has found that judges do not have that power. United States v. Clayton, 927 F.2d 491, 492-93 (1991).
