Arrests Show Kinky People's Sex Rights at Mercy of State

If one person gets sexually excited by being spanked (with a hand, spatula, wet noodle, whatever) and another person gets excited by doing the spanking, and they go to a party in a warehouse, pay $25 each and commence with said spanking, does the state have the right to arrest them?
