Conflicts Checks Must Be Thorough and Accurate

Ribakoff With limited exceptions, the California Rules of Professional Conduct forbid lawyers from accepting compensation from anyone other than the client to pay for the client's representation. See Rule 3-310(F). However, in the insured-insurer context, this ethical rule does not prevent insurers from unilaterally selecting and paying for insureds' counsel when there is no conflict of interest between the insured and insurer.
